RMC No. 117-2022 (August 8, 2022) publishes the full text of Memorandum Circular No. 3, s. 2022, which amends and supplements MC No. 1, s. 2022. Under MC No. 3, Officers-in-Charge of departments, agencies, bureaus and offices, non-Career Executive Service officials occupying CES positions, and contractual or casual employees covered by the Circular continue performing their duties until 31 December 2022 or until a replacement is appointed or designated, whichever comes first, and must lawfully perform their duties and submit bi-monthly performance reports. The vacancy rules in MC Nos. 1 and 3 do not apply to GOCCs, government instrumentalities with corporate powers, government corporate entities, and government financial institutions, which remain governed by their charters, articles of incorporation and by-laws under RA No. 10149. Except for those involved in the food, transportation and energy sectors, or when authorized by the President in meritorious cases, OICs, the GOCC/GFI group, and free port and special economic zone authorities may not enter into new contracts or projects or disburse extraordinary funds. The circular does not address any tax obligation.
