Lumagui, Jr.'s request for continuing authority to appoint or hire new employees and to transfer or detail BIR officers and employees in connection with the October 30, 2023 Barangay and Sangguniang Kabataan Elections (BSKE). The approval is subject to conditions: orders must be signed and issued solely by the Commissioner of Internal Revenue; actions must be essential to the proper functioning of the office and must not influence the conduct of the BSKE; no promotion or increase of salary, remuneration, or privilege is allowed during the 45-day period before the BSKE, without exception; the authorization is prospective and subject to Civil Service Law rules on personnel actions/movements; and the required notices under Section 393(d) of Resolution No. 10924 must be promptly sent to COMELEC through its Law Department.
