RMO No. 36-2022 (September 15, 2022) prescribes guidelines and procedures for accepting Information and Communications Technology (ICT) systems/solutions donated to the BIR at no cost by a Third Party Developer (TPD)/Provider. A TPD must submit a Letter of Intent with a technical proposal, then a draft MOA/MOU, signed NDA and signed AUP before starting work; the proposal is evaluated by the Process Owner with the ISG Project Manager, and a Privacy Impact Assessment is conducted at the start of the project. The development engagement shall not exceed one (1) year, changes to scope/timelines require a Change Request, and the system undergoes a walkthrough, acceptance testing per RMO No. 24-2003, and migration per ISG Memorandum Order No. 2-2016. Because it is a donation, all system/technical documentation becomes BIR property, a separate Deed of Donation is processed per RMO No. 15-2020, and a Project Closure Report is submitted per ISG Memorandum Order No. 1-2022.
